الشروط والأحكام
1. من نحن وقبول الشروط
«بن كار» (BinCar) تطبيق وموقع تشغّله [اسم المنشأة / Company name]، سجل تجاري رقم [السجل التجاري / CR number]، المملكة العربية السعودية («بن كار» أو «نحن»). باستخدامك التطبيق أو إنشاء حساب فيه فإنك توافق على هذه الشروط وعلى سياسة الخصوصية. إن لم توافق فلا تستخدم الخدمة. للتواصل: support@bincar.co.
2. ما هي الخدمة
بن كار منصة تربط المشترين بالتشاليح ومحلات قطع الغيار الجديدة. يمكنك عبرها:
- إنشاء طلب قطعة مع رقم الهيكل (VIN) وصور وملاحظات صوتية وموقعك، لتصل إلى التجار المطابقين.
- استقبال عروض الأسعار ومقارنتها والتحدث مع التجار عبر المحادثة داخل التطبيق.
- عرض سيارة متضررة للبيع ليقدّم التشاليح مزايداتهم، ثم اختيار المزايدة المناسبة.
- للتجار: إصدار فواتير داخل التطبيق.
الخدمة مجانية حالياً، وقد نضيف رسوماً مستقبلاً بعد إشعارك مسبقاً.
بن كار وسيط تقني فقط. البيع والشراء يتمان بينك وبين التاجر أو البائع مباشرة. لسنا طرفاً في عقد البيع، ولا نملك القطع أو السيارات المعروضة ولا نفحصها، ولا نضمن جودتها أو مطابقتها أو سعرها.
3. الحساب
- يجب أن يكون عمرك 18 سنة فأكثر. التطبيق غير موجّه لمن هم دون ذلك.
- تسجّل الدخول برقم جوالك عبر رمز تحقق يصلك برسالة نصية. أنت مسؤول عن حسابك وعن كل ما يتم من خلاله، وعن صحة بياناتك.
- يمكنك حذف حسابك من داخل التطبيق. تفاصيل ما يُحذف وما يُحتفظ به في سياسة الخصوصية.
4. الدفع
لا تعالج بن كار أي مدفوعات ولا تستلم أموال الصفقات ولا تحتفظ بها. يتم الدفع والاستلام مباشرة بين المشتري والتاجر خارج التطبيق، وبالطريقة التي يتفقان عليها. أي مبلغ تدفعه خارج التطبيق تدفعه على مسؤوليتك.
5. الفواتير و«الحماية»
يُصدر التاجر الفاتورة داخل التطبيق ويقبلها المشتري داخل التطبيق. وتترتب على ذلك الآتي:
- الصفقات التي صدرت لها فاتورة داخل التطبيق وقُبلت فيها فقط مؤهلة لإجراء النزاعات لدى بن كار.
- يمكن فتح نزاع خلال مدة النزاع المحددة في التطبيق، وهي افتراضياً 14 يوماً بعد استلام الطلب. وقد تُعدَّل هذه المدة وتُعرض لك في التطبيق.
- تتوسط بن كار بين الطرفين في النزاع وتراجع ما يقدمانه من فواتير ومحادثات وصور، ويجوز لها اتخاذ إجراءات بحق التاجر المخالف كالتحذير أو التقييد أو الإيقاف أو الحظر.
- الوساطة جهد معقول لتسوية الخلاف وليست حكماً قضائياً ولا ضماناً لنتيجة معينة، ولا تمنع أي طرف من اللجوء إلى الجهات المختصة.
- لا تضمن بن كار القطع، ولا تتحمل مسؤولية أي تعامل أو اتفاق أو دفع يتم خارج التطبيق أو دون فاتورة مقبولة فيه.
إذا أرسل أحد الطرفين رقم جوال أو بريداً أو رابطاً في المحادثة فقد يعرض التطبيق تحذيراً. ننصح بإبقاء الاتفاق والفاتورة داخل التطبيق لتبقى مؤهلة للحماية.
6. التجار
- التسجيل كتاجر فوري. ويمكن اختيارياً تقديم السجل التجاري ليراجعه مشرف بن كار، وعند الموافقة تظهر شارة «موثّق». الشارة تعني مراجعة السجل التجاري فقط، ولا تعني ضماناً لجودة القطع أو سلوك التاجر.
- التاجر مسؤول عن دقة بياناته وعروضه ووصف القطع وحالتها (مستعمل أو جديد) وصور القطع، وعن الضمان الذي يقدّمه ومدته، وعن التزامه بما قبل به في العرض والفاتورة.
- التاجر مسؤول عن التزاماته النظامية والضريبية. إذا أدخل رقمه الضريبي فتُظهر الفواتير ضريبة القيمة المضافة بنسبة 15%.
- على التشاليح تقديم عروض القطع المستعملة فقط على طلبات القطع المستعملة.
7. بيع السيارات المتضررة
يعرض البائع سيارته المتضررة، ويقدّم التشاليح مزايداتهم، ويختار البائع المزايدة التي يريدها. بعد ذلك يُصدر التاجر الذي اختاره البائع فاتورة يكون فيها هو الدافع. يتم تسليم السيارة وسداد المبلغ بين الطرفين مباشرة، وتنطبق عليهما أحكام البنود 2 و4 و5.
8. السلوك المحظور
يُمنع عليك:
- تقديم معلومات كاذبة أو مضللة، أو انتحال شخصية أو جهة أو سجل تجاري.
- عرض قطع أو سيارات مسروقة أو غير مشروعة أو لا تملك حق بيعها.
- الاحتيال أو التلاعب بالأسعار أو العروض أو التقييمات، أو إنشاء حسابات متعددة للتحايل.
- الإساءة أو التهديد أو التحرش أو المحتوى المخالف للنظام أو الآداب العامة في الطلبات أو المحادثات أو الصور أو الملاحظات الصوتية.
- تجاوز التطبيق لتفادي الفواتير وإجراءات النزاع، أو استخدام المحادثة لأغراض غير الصفقة.
- جمع بيانات المستخدمين أو استخدامها لغير غرض الصفقة، أو الإخلال بأمن الخدمة أو محاولة الوصول غير المصرح به إليها.
9. التقييمات والبلاغات والحظر
- لا يمكن تقييم التاجر إلا بعد اكتمال الصفقة. يجب أن يكون التقييم صادقاً ومبنياً على تجربتك الفعلية.
- يمكنك الإبلاغ عن مستخدم أو محتوى، وحظر مستخدم لمنعه من التواصل معك.
- يجوز لبن كار إزالة محتوى أو تقييم يخالف هذه الشروط.
10. الإيقاف والحظر
يجوز لبن كار تحذيرك أو تقييد حسابك أو إيقافه أو حظره، مؤقتاً أو نهائياً، إذا خالفت هذه الشروط أو أضررت بمستخدمين آخرين أو بالخدمة. يمكنك التوقف عن استخدام الخدمة وحذف حسابك في أي وقت.
11. المحتوى الذي تقدمه
تبقى ملكية ما ترفعه من نصوص وصور وملاحظات صوتية لك. وتمنحنا ترخيصاً محدوداً لاستضافتها وعرضها لمن تتعامل معهم ضمن الخدمة بالقدر اللازم لتشغيلها. أنت مسؤول عن أن لديك الحق في رفع هذا المحتوى.
12. إخلاء المسؤولية وحدود المسؤولية
تُقدَّم الخدمة «كما هي» ودون ضمان بتوفرها المستمر أو خلوها من الأخطاء. في الحدود التي يسمح بها النظام، لا تتحمل بن كار المسؤولية عن جودة القطع أو السيارات أو مطابقتها أو سعرها، ولا عن تصرفات المستخدمين أو التجار، ولا عن أي تعامل أو دفع خارج التطبيق، ولا عن الخسائر غير المباشرة. لا يستبعد ذلك أي مسؤولية لا يجوز استبعادها نظاماً.
13. التعديل على الشروط والخدمة
قد نعدّل هذه الشروط أو الخدمة. سنُشعرك بالتغييرات الجوهرية داخل التطبيق أو بوسيلة مناسبة، واستمرارك في الاستخدام بعد سريانها يعني موافقتك عليها.
14. النظام الواجب التطبيق
تخضع هذه الشروط لأنظمة المملكة العربية السعودية. الجهة المختصة بنظر النزاعات: [يُحدَّد بعد المراجعة القانونية].

Terms and Conditions
1. Who we are and acceptance
BinCar (بن كار) is an app and website operated by [اسم المنشأة / Company name], commercial registration no. [السجل التجاري / CR number], Kingdom of Saudi Arabia ("BinCar", "we"). By using the app or creating an account you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service. Contact: support@bincar.co.
2. The service
BinCar connects buyers with junkyards (tashaleeh) and new-parts shops. Through it you can:
- Create a parts request with a VIN, photos, voice notes and your location, so that it reaches matching merchants.
- Receive and compare quotes, and chat with merchants inside the app.
- List a wrecked car for sale so junkyards can bid, then choose the bid you prefer.
- For merchants: issue invoices inside the app.
The service is free for now. We may introduce fees in the future after giving you advance notice.
BinCar is a technology intermediary only. Sales happen directly between you and the merchant or seller. We are not a party to the sale contract, we do not own or inspect the listed parts or cars, and we do not guarantee their quality, conformity or price.
3. Your account
- You must be at least 18 years old. The app is not intended for anyone younger.
- You sign in with your mobile number using a one-time code sent by SMS. You are responsible for your account, for everything done through it, and for the accuracy of your information.
- You can delete your account from inside the app. See the Privacy Policy for what is deleted and what is kept.
4. Payments
BinCar does not process payments and does not receive or hold the money for any deal. Payment and handover take place directly between the buyer and the merchant, outside the app, in the way they agree. Any payment you make outside the app is at your own risk.
5. Invoices and "Protection"
The merchant issues the invoice inside the app and the buyer accepts it inside the app. As a result:
- Only deals with an invoice issued and accepted in the app are eligible for BinCar's dispute process.
- A dispute can be opened within the dispute window set in the app, by default 14 days after you receive the order. This window may be changed and is shown to you in the app.
- BinCar mediates between the parties, reviews the invoices, chats and photos they provide, and may take action against a merchant who breaches the rules, such as a warning, restriction, suspension or ban.
- Mediation is a reasonable effort to settle a disagreement. It is not a court ruling or a guarantee of any outcome, and it does not stop either party from going to the competent authorities.
- BinCar does not guarantee parts and is not liable for any dealing, agreement or payment made outside the app or without an accepted invoice in it.
If a phone number, email address or link is shared in chat, the app may show a warning. We recommend keeping the agreement and the invoice inside the app so the deal remains eligible for protection.
6. Merchants
- Merchant registration is instant. A merchant may optionally submit a commercial registration (CR) for review by a BinCar admin; once approved, a "Verified" badge is shown. The badge only means the CR was reviewed. It is not a guarantee of part quality or of the merchant's conduct.
- Merchants are responsible for the accuracy of their details, quotes, part descriptions, condition (used or new) and photos, for any warranty they offer and its duration, and for honouring what they agreed in the quote and invoice.
- Merchants are responsible for their own legal and tax obligations. When a merchant provides a VAT number, invoices show 15% VAT.
- Junkyards may only quote used parts on used-part requests.
7. Wrecked-car sales
The seller lists the wrecked car, junkyards place bids, and the seller selects a bid. The merchant whose bid was selected then issues the invoice, in which the merchant is the paying party. Handover of the car and payment take place directly between the parties, and sections 2, 4 and 5 apply.
8. Prohibited conduct
You must not:
- Provide false or misleading information, or impersonate a person, business or commercial registration.
- List stolen or unlawful parts or cars, or items you have no right to sell.
- Commit fraud, manipulate prices, quotes or reviews, or create multiple accounts to evade rules.
- Abuse, threaten or harass others, or post unlawful or indecent content in requests, chats, photos or voice notes.
- Bypass the app to avoid invoices and dispute procedures, or use chat for purposes other than the deal.
- Harvest user data or use it for anything other than the deal, compromise the security of the service, or attempt unauthorized access.
9. Reviews, reports and blocking
- A merchant can be reviewed only after a deal is completed. Reviews must be honest and based on your actual experience.
- You can report a user or content, and block a user to stop them contacting you.
- BinCar may remove content or reviews that breach these Terms.
10. Suspension and bans
BinCar may warn you, restrict, suspend or ban your account, temporarily or permanently, if you breach these Terms or harm other users or the service. You may stop using the service and delete your account at any time.
11. Content you provide
You keep ownership of the text, photos and voice notes you upload. You grant us a limited licence to host and show them to the people you deal with in the service, as needed to run it. You are responsible for having the right to upload that content.
12. Disclaimer and limitation of liability
The service is provided "as is", without any promise of uninterrupted availability or freedom from errors. To the extent permitted by law, BinCar is not liable for the quality, conformity or price of parts or cars, for the acts of users or merchants, for any dealing or payment outside the app, or for indirect losses. Nothing here excludes liability that cannot be excluded by law.
13. Changes
We may change these Terms or the service. We will notify you of material changes in the app or by another suitable means. Continuing to use the service after they take effect means you accept them.
14. Governing law
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Competent authority for disputes: [to be set after legal review].
